ORDER RE: CASE MANAGEMENT AND DISMISSAL OF ACTION
The Court has ordered the following after review of the case.
Plaintiff's attorney is ordered to appear by Zoom to respond to OSC WHY CASE SHOULD NOT BE DISMISSED FOR REPEATED FAILURE TO PROSECUTE, FAILURE TO SERVE THE COMPLAINT, FAILURE TO FILE A PROOF OF SERVICE.
Plaintiff's attorney reported at 2/24/2026 CMC that they would pursue the filing of a notice of publication. No Proof of Service is filed. Nothing was filed in furtherance of application for publication. Complaint was filed on 2/22/2024. The complaint has been filed for 28 months. Plaintiff's attorney has been on notice of the court's intention to dismiss this case for failure to prosecute.
RULES FOR CONTESTING THIS TENTATIVE ORDER If a party wishes to contest this Tentative Case Management Order, they must indicate on-line and by emails to Department 19 and all other counsel by 11 a.m. on June 16, 2026. The matter will then be set for an in-person or on-line conference at 3:00 p.m. on either June 169, 2026, or an alternate date.
