PLAINTIFF 1748 FELL ST. LLC Notice Of Motion And Motion For Entry Of Judgment is DENIED without prejudice. No foundation for the statements that Defendant failed to vacate the premises and failed to tender a payment by the vacate date.
The Court also notes that Plaintiff's papers indicate that this is an unlimited jurisdiction action and Plaintiff is seeking monetary damages in an amount over the maximum for limited jurisdiction cases. However, although Plaintiff's pleadings state this is an unlimited jurisdiction case, due to the notation of "(amount exceeds $10,000)" on that pleading, the first filing fee was assessed in the amount for a limited jurisdiction case over $10,000. Plaintiff is directed to pay the difference in filing fee for unlimited jurisdiction cases before, or concurrently with, filing any further motion for judgment exceeding the cap for limited jurisdiction. =(501/CFH)
