PLAINTIFF FIVE ELEMENTS, LLC MOTION FOR SUMMARY JUDGMENT is DENIED. Plaintiff has not met its initial burden of showing that it is entitled to judgment as a matter of law based on the facts presented. Specifically, the 3-Day Notice to Pay Rent or Quit expressly includes amounts that are not rent, and Plaintiff includes no discussion of any legal authority for the propriety of including these amounts in its 3-Day Notice to Pay Rent or Quit. Additionally, Plaintiff cites no authority for the proposition that it may recover rent in excess of the amount demanded in the 3-Day Notice to Pay Rent or Quit in connection with this action, based on additional rent that accrued after the expiration of that Notice which included a declaration of forfeiture.
