DEFENDANT HEAVENLY SAMUEL, DA'MON POLK DEMURRER to Amended COMPLAINT is OVERRULED. Plaintiff's 3 Day Notice provides a clear sum pursuant to CCP 1161(2). Further, the Proofs of Service for the Notice show that the Notice was both posted and mailed to Defendants, in compliance with CCP 1162(3). The similarities in the corporate verifications in the original Complaint and First Amended Complaint does not make the First Amended Complaint uncertain pursuant to CCP 430.10(f). Opposition is stricken as no Proof of Service is on file. =(501/CFH)
