CASE # CASE NAME HEARING NAME MOTION TO ENFORCE SETTLEMENT AGREEMENT PURSUANT TO CCP CVPS2305263 PRIETO VS DAMORE SEC. 664.6 AND FOR AWARD OF ATTORNEY FEES OF $2,500 Tentative Ruling: No opposition filed by Defendant. In review of the signed Settlement Agreement “Agreement” filed with the court on August 6, 2025, the court notes that the terms specifically state Mr. Damore is to pay Ms. Prieto for her 65% interest AND refinance the property resulting in her removal from the mortgage and property deed. (See ¶¶ 2-3 of Agreement) Motion to Enforce Settlement Agreement Pursuant to CCP §664.6 GRANTED.

Plaintiff to submit a proposed judgment to the court in 5 days. The proposed judgment shall reflect granting enforcement of ¶ 6 of Agreement and credit for Damore’s $135,000 payment to Prieto. Attorneys Fees GRANTED in the amount of $1655 (3 hours motion preparation + assistant time + filing), payable to Plaintiff’s attorney.

Tentative Ruling: No opposition filed by Plaintiff. Motion to Quash Service of Summons and Amended Complaint GRANTED. Service of the summons and amended complaint upon Safari Park, LLC is quashed. The Order to Show Cause re default is vacated. The Case Management Conference is continued from June 11, 2026 to September 10, 2026. An Order to Show Cause re proof of service will be set for September 10, 2026. No Sanctions shall be imposed.
