The motion of Proposed Intervenor Ernesto Chavez (Proposed Intervenor) for leave to intervene is unopposed and GRANTED.
This is a bad faith action arising from an insurance contract issued by Defendant Loya Casualty Insurance Company to Proposed Intervenor (Defendant). Plaintiff Leslie Yang commenced this action following the assignment of Proposed Intervenors rights against Defendant. Proposed Intervenor asserts that he retains an interest in the action because his rights to emotional distress and punitive damages are unassignable. Proposed Intervenor therefore seeks to file a complaint in intervention to pursue such damages. Defendant filed a non-opposition indicating it does not oppose the motion.
Based on the foregoing, the Court finds good cause for intervention. The motion is granted. The pleading in intervention shall be filed upon presentment to the clerk and payment of the requisite filing fee.
This case has been assigned to Department 47 for hearing. In the event that either party requests a hearing the matter will be heard at 9:30 a.m. in Department 47. Any party requesting an oral argument must contact the clerk at (916) 874-5487 and opposing counsel or parties in pro per by 12:00 p.m. on the court day before the hearing. If a proper request for hearing is not made, this shall become the order of the Court.
