Motion: Plaintiff’s Motion to Transfer (No Opposition Filed)

Tentative Ruling: Plaintiff’s motion to transfer venue is DENIED without prejudice to refile, clarifying the location of the injury.

Plaintiff’s motion contains a notable internal inconsistency regarding the location of the incidents. The Memorandum of Points and Authorities identifies the facility where the abuse occurred as being located at 15180 Euclid Ave., Chino, CA 91710, in San Bernardino County. However, the supporting Declaration of Andrew M. Morrow III identifies a different address entirely 4400 Ming Ave., Bakersfield, Kern County as the location of the incidents, which would place venue in Kern County rather than San Bernardino County. The declaration nonetheless requests transfer to San Bernardino County Superior Court, consistent with the memorandum. In addition, the caption for the proposed order lists Alameda County.
