Tentative Ruling - 06/05/2026 Jamilah A. Jefferson
The Motion re: Motion to Modify Automatic Stay of Proceedings filed by May Chen on 04/09/2026 is Granted.
The unopposed Motion of Plaintiff May Chen (Plaintiff) to Modify Stay is GRANTED. As of the posting of this tentative ruling, there is no opposition filed.
In light of the lack of any of the Defendants Opposition, Defendants Meiying Wang and Wei Jiang have not shown that as nondebtors, there are any narrow exceptions in unique circumstances in which the automatic stay could extend to them. (Cross v. Cooper (2011) 197 Cal.App.4th 357, 365, fn. 2.) The Notice of Stay of Proceedings filed on January 12, 2026, was filed by all three nondefaulted defendants but the underlying Petition pertained only to Defendant Meetco International LLC, even if it was executed by Defendant Meiying Wang as Meetcos authorized representative.
For clarity purposes, Defendant Meetco International may refile a Notice of Bankruptcy Stay as to only itself as applicable.
