TENTATIVE RULING: FOUR DISCOVERY MOTIONS AND REQUESTS FOR SANCTIONS GRANTED
Defendant HSBC Bank USA has filed four separate discovery motions for today’s law and motion calendar and they are slotted as lines one through four. Each is identified on Odyssey as a Motion to Deem Facts as Admitted. However, they are actually (1) two motions to compel responses to written discovery, one as to each of two plaintiffs; and (2) two motions to deem requests for its first set of admissions admitted, one as to each of two plaintiffs. Each motion requests sanctions and all four motions are unopposed.
This tentative addresses all four motions. All four motions are GRANTED. While it is not clear to the Court how much time was spent on each of the individual motions, it is clear from the declaration of counsel that more than three hours were expended on the motions at $330 per hour and that at least $1000 is a reasonable amount for all four motions. Accordingly, the court Orders four sanctions of $310 (which includes filing fees), one for each motion. More specifically:
Plaintiff Ammar Khan shall serve verified responses, without objection, to defendant’s Form interrogatories, Set One, Special Interrogatories, Set One and Requests for Production of Documents, Set One, within 14 days. Plaintiff shall pay defendant $310 within 30 days as to this motion. The genuineness of any documents and the truth of any matters in defendant’s Requests for Admission, Set One, served on plaintiff Ammar Khan are deemed admitted. Plaintiff shall pay defendant another $310 within 30 days as to this additional motion.
Plaintiff Shazia Ammar shall serve verified responses, without objection, to defendant’s Form interrogatories, Set One, Special Interrogatories, Set One and Requests for Production of Documents, Set One, within 14 days. Plaintiff shall pay defendant $310 within 30 days as to this motion. The genuineness of any documents and the truth of any matters in defendant’s Requests for Admission, Set One, served on plaintiff Shazia Ammar are deemed admitted. Plaintiff shall pay defendant another $310 within 30 days as to this additional motion.
Any party who contests a tentative ruling must email Dept11@sanmateocourt.org with a copy to all other parties by 4:00 p.m. stating, without argument, the portion(s) of the tentative ruling that the party contests.
If the tentative ruling is uncontested, it shall become the order of the court. Thereafter, defendant’s counsel shall prepare a written order consistent with the court’s ruling for the court’s signature, pursuant to California Rules of Court, Rule 3.1312 and Local Rule 3.403(b)(iv), and provide written notice of the ruling to all parties who have appeared in this action. The order should be e-filed only, do not email or mail a hard copy to the court.
