TENTATIVE RULING:
Defendant Diana Iris Patchett’s Motion for Terminating Sanctions is DENIED without prejudice to a renewed motion.
The parties are ORDERED to appear at a case management conference at 9:00 am in Department 28 on July 29, 2026. The case management conference scheduled in Department 30 is vacated.
Defendant’s Notice of Motion indicates that the hearing will be held on March 18, 2026. That date is stricken out on the filed copy, with June 3, 2026 typed in. No proof of service has been filed indicating that a corrected notice was served on plaintiff; service of the original notice is insufficient to provide notice of the June 3, 2026 hearing date.
Additionally, the Notice of Motion does not provide the location of the hearing as required by California Rules of Court, rule 3.1110(b)(1).
If the tentative ruling is uncontested, it shall become the order of the court. Thereafter, defendant’s counsel shall prepare a written order consistent with the court’s ruling for the court’s signature, pursuant to California Rules of Court, Rule 3.1312 and Local Rule 3.403(b)(iv), and provide written notice of the ruling to all parties who have appeared in this action. The order should be e-filed only, do not email or mail a hard copy to the court.
