Tentative Ruling
NOTICE:
Please take notice, Department 54 has moved to Department 16C at the Tani G. Cantil- Sakauye Courthouse. The new courthouse is located at 500 G Street, Sacramento, CA 95814.
TENTATIVE RULING:
Plaintiffs in pro per Nafisah Timmons and Zuri K. Colberts (collectively, Plaintiffs) motion for reconsideration of the December 18, 2025, Entry of Judgment is DROPPED for lack of jurisdiction.
Plaintiffs move for reconsideration of the Judgment that was entered on December 9, 2025. Notice of Entry of Judgment was filed on December 18, 2025. Plaintiffs filed this motion on December 29, 2025, seeking reconsideration pursuant to Code of Civil Procedure section 1008.
After entry of judgment, the superior court [does] not have jurisdiction to entertain or decide a motion for reconsideration. [Citations.] (Aguilar v. Atlantic Richfield Co. (2001) 25 Cal.4th 826, 859, fn. 29; accord APRI Ins. Co. v. Superior Court (1999) 76 Cal.App.4th 176, 182.) A motion for reconsideration may only be considered before final judgment is entered and while the case is still pending in the trial court. (Eddy v. Sharp (1988) 199 Cal.App.3d 858, 863, fn. 3.) The issue is jurisdictional. Once the trial court has entered judgment, it is without power to grant reconsideration. The fact that a motion for reconsideration may have been pending when judgment was entered does not restore power to the trial court. (APRI, Ins. Co., supra, 76 Cal.App.4th at 182.)
As judgment has been entered, the Court lacks jurisdiction to hear the instant motion and the motion is DROPPED.
