The order to show cause is continued for hearing to July 20, 2026. The court's prior order did not require the OSC to be served in the same manner as a summons and complaint. This was erroneous, and the court lacks jurisdiction to issue a preliminary injunction unless defendants Robert Girvin and Formist Studio have either appeared in the action or have been served in the same manner as a summons and complaint. (See Rules of Court, Rule 3.1150, subd. (a).)
The court continues the OSC for hearing to July 20, 2026. Plaintiff shall serve a copy of this order and the May 1, 2026 Order Granting Temporary Restraining Order; Order to Show Cause re Preliminary Injunction on defendants in the same manner as required by the Code of Civil Procedure for a summons and complaint on defendants Robert Girvin and Formist Studio forthwith. The court cautions plaintiff to comply strictly with the Code's service requirements. Plaintiff shall file the proofs of service at least five court days in advance of the continued hearing date. The TRO previously issued remains in place but will be dissolved if Plaintiff has not accomplished service by the continued hearing date.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 301 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. To appear remotely at the hearing, go to the court's website at sfsuperiorcourt.org under "Online Services," navigate to "Tentative Rulings," and click on the appropriate link, or dial the corresponding phone number.
Any party who contests a tentative ruling must send an email to contestdept301tr@sftc.org with a copy to all other parties by 4pm stating, without argument, the portion(s) of the tentative ruling that the party contests. The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept301tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
