Ben Delashmutt filed this action on October 24, 2025. A first amended complaint was filed on January 23, 2026, and a second amended complaint was filed on April 3, 2026. On May 19, 2026, the Court entered an order on the parties’ stipulation granting Plaintiff leave to file a third amended complaint and extending the deadline for defendants Rob Reynolds, Rob Reynolds Construction, Inc. and Arita Oyuki to respond to the second amended complaint to August 3, 2026.

Now on calendar is Rob Reynolds, Rob Reynolds Construction, Inc. and Arita Oyuki’s demurrer to the original complaint. The complaint is no longer the operative pleading in the action and the demurrer is therefore overruled as moot.
