Defendant is represented limited scope. All papers in the case must be served both on the defendant's limited scope attorney and on the defendant. (CRC 3.36.) The proofs of service indicate that the moving papers were served on the limited scope attorney only.
The Court notes that this matter was previously continued at plaintiff's request based on the representation that the moving papers had in fact been served on the defendant, and proof of service reflecting as much would be filed. However, no such proof of service has been filed. Per CRC 3.1300(c), proof of service of the moving papers must be filed no later than five court days before the time appointed for the hearing. =(501/CFH)
