PETITIONER SARAH LEWIS APPLICATION FOR PETITION FOR ENFORCEMENT OF JUDGEMENT FOR PROPORTIONAL RENT CLAIM BY A SUBTENANT AGAINST A MASTER TENANT is OFF CALENDAR.

Insufficient notice per Code of Civil Procedure 1005(b). The moving papers were filed and served on May 14th for a hearing set on June 5th. "[A]ll moving and supporting papers shall be served and filed at least 16 court days before the hearing. ... However, if the notice is served by mail, the required 16-day period of notice before the hearing shall be increased by five calendar days if the place of mailing and the place of address are within the State of California."

The Court also notes that Petitioner claims to have served Respondent with documents via email, but has not established that Respondent, who is in Pro Per, consented to email service. =(501/HEK)
