Plaintiff State Farm Mutual Automobile Insurance Company's unopposed Motion to Vacate the Default is GRANTED. Defendant moves under Code of Civil Procedure section 473(d), which allows a court to set aside a void default. The record demonstrates the default is void because Plaintiff had not properly served Defendant prior to the default. The court orders the 5/15/2026 default is ordered vacated.
Plaintiff is ordered to prepare a proposed order which repeats verbatim the above text and email it to contestdept302tr@sftc.org prior to the time set for hearing.
