Defendant's Demurrer to Complaint is SUSTAINED in part, subject to opposition, with leave to amend within 5 days of entry of order.
The amount of rent which the Complaint alleges the defendant was required to pay per the terms of the 2017 lease is not the amount the attached 2017 lease actually requires, and the Complaint does not allege that there have been any changes to the terms of the lease. Therefore, the Complaint fails to state facts sufficient to show that the monthly amounts demanded in the Notice were no more than the actual amounts due. The Complaint is impermissibly uncertain for the same reason. =(501/CFH)
