Defendants' Demurrer to Complaint is OVERRULED, 5 days to answer. The Complaint states a cause of action for unlawful detainer and is not uncertain. The validation notice identifies plaintiff by name as the creditor, in compliance with the requirements of the FDCPA. Defendants have not identified any provision of the FDCPA which also requires the validation notice to provide a description of the creditor. Further, the Complaint alleges on its face that plaintiff is the owner of the premises, and defendants appear to assert that they have already confirmed this is true. It is clear defendants can reasonably respond notwithstanding any technical ambiguity regarding this point. =(501/CFH)
