Plaintiff's Motion to Deem Admitted Trust of Matters Specified in Plaintiff's First Set of Requests for Admission, and for Monetary Sanctions Against Defendant is DENIED. Defendant has filed a substantially compliant response. Request for monetary sanctions is denied. Plaintiff failed to file proof of service of the discovery at issue with the moving papers, and thus did not show that defendant failed to file a timely response as referenced in CCP 2033.280(c). New evidence filed only in reply which is essential to the relief requested in the motion is stricken. =(501/CFH)
