Plaintiff's Motion to Set Aside Order Sustaining Defendant's Demurrer is GRANTED. The Order Sustaining Defendant's Demurrer is invalid because the demurrer was not served on plaintiff, and therefore the Court should not have ruled on it. Subsequent service of notice of entry of the invalid Order Sustaining Defendant's Demurrer does not make it valid. Defendant shall have five days from notice of entry of the order on this motion to file and serve a response to the Complaint. =(501/SKF)
