Defendant's Motion Vacate Default, Default Judgment and Amended Default Judgment, and to Recall Writ of Possession is GRANTED, pursuant to CCP 473(b). No opposition filed. The default of defendant Chien K Tran (sued as Chieu K Tran) is set aside. The default judgment entered on July 10, 2025 is vacated. The writ issued on July 11, 2025 is recalled. Defendant Chien K Tran (sued as Chieu K Tran) shall file and serve the proposed response within five days. The Court notes that Eshagian v. Cepeda (2025) 112 Cal.App.5th 433, for which defendant provides an incorrect citation, does not stand for the proposition defendant claims. =(501/CFH)
