Plaintiff Ruben Martinez's Motion To Compel Defendant Scott Rawson's Response To Plaintiff's Demand For Production Of Documents And Things, Set No. One, and for Sanctions is GRANTED. The discovery requests at issue appear reasonably calculated to lead to the discovery of admissible evidence. (See Code of Civil Procedure section 2017.010.) The record demonstrates Defendant Scott Rawson did not provide any responses to the RFPs. No meet and confer requirement exists for motions to compel responses for requests for production of documents when no responses have been provided. (Code of Civil Procedure section 2031.300.)
Defendant Scott Rawson shall serve verified, objection-free, responses to Plaintiff's RFPs, Set One by September 25, 2025. Defendant Scott Rawson did not act with substantial justification in connection with this discovery. Defendant Scott Rawson shall pay $860 to Plaintiffs as sanctions, payment no later than September 25, 2025. (See Code of Civil Procedure 2031.300(c).)
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 302 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept302tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
