2026PRCP061203: IN THE MATTER OF JOSE ALFREDO VALENCIA 09/04/2026 in Department J6 Hearing on Petition for Appointment of Conservator of the Person

1. As of 8/31/26 no proof of service for the 9/4/28 hearing has been served. Form GC-020 should have been filed showing that notice was served at least 15 days before the hearing to (i) relatives named in the petition (2nd degree) and (ii) proposed conservatee’s attorney. (Probate Code §1822.)

2. As of 8/31/26 no proof of service for the 9/4/28 hearing has been served showing that notice and the petition has been served at least 30 days to the regional center. (Probate Code §1822.) As assessment from the regional center has also not been filed as of 8/31/26.

3. The proof of service for the citation shows service by mail, which is not a permitted manner of service. The proposed conservatee must be personally served with the citation and a copy of the petition at least 15 days prior to the hearing (or served in the manner of Code of Civil Procedure section 415.30). (Probate Code § 1824.)

4. As noted in the 7/31/26 probate note, the petition fails to check any orders requested at Paragraph 1. The amended petition still does not request any orders. Are no orders being requested?

5. Paragraph 3f of the petition is not completed and attachments 3f(1) and 3f(2) are not included with the petition.

Petitioner to file a verified supplement completing the petition (see defects noted above), proof of service of citation, and statutorily sufficient proof of service of the Notice of Hearing (GC-020).

The Court continues the hearing to 11/6/26 at 9:00 a.m. in Department J6.

Petitioner is directed to the Self-Help Legal Access Center for assistance with forms.

The clerk shall give notice.
