Cross-defendants Citivision Commercial Real Estate, Inc. and M & E Development move to compel further responses to certain discovery and for sanctions. Before the initial hearing on their motion, TheraNova LLC dismissed its claims against them. Cross-defendants nonetheless seek sanctions in the form of their fees incurred in bringing the motion to compel, entitlement to which survives dismissal. TheraNova does not defend its responses, and the court concludes its objections lack merit. The court orders TheraNova LLC to pay $500 in sanctions to Citivision Commercial Real Estate, Inc. and M & E Development within 30 days of entry of this order.
The court reduces the sanctions request significantly in light of all the circumstances of this case, including that cross-defendants have achieved dismissal of the claims against them, and that cross-defendants' fees and number of hours expended are unusually high for a motion like this.
