Defendants Johnson & Johnsons and Pecos River Talc LLCs (Defendants) Motion for Relief from Inadvertent Waiver of Objections to Written Discovery Responses is GRANTED IN PART and DENIED IN PART.
The Court DENIES Defendants Motion with respect to Defendants Introductory Statements, Defendants Objections to Definitions and Specific Objections to Multiple Interrogatories/Requests for Admissions/Requests for Production. None of this matter is authorized by CCP §§ 2030.210 et seq., 2031.210 et seq. or 2033.210 et seq. Instead, all objections need to be stated in the Response to each specific written discovery request. (CCP §§ 2030.210(a), 2031.210(a), and 2033.210(a) and (b).)
The Court GRANTS the Motion with respect to any objections propounded expressly in the specific response to each written discovery request. Plaintiffs will not be significantly prejudiced by allowing Defendants to assert these objections. Even if the time has expired for Plaintiffs to bring a motion to compel further responses to contested Responses, this appears to be the result of Plaintiffs service of written discovery on 7/13/2026, where the Court had granted Plaintiffs Preference Motion on 5/12/2026 setting a 9/8/2026 preference trial with appropriate discovery cutoff dates shortly before the preference trial date, rather than Defendants failure to serve verified Responses until five days after the deadline.
Fact discovery closed in this action on 8/24/2026 and the matter will be assigned to a trial department.
