Defendant San Francisco Bay Area Water Emergency Transportation Authority's unopposed motion to compel responses to its first set of special interrogatories and first set of requests for production of documents is granted. The court further grants the Transportation Authority's motion for sanctions.
The Transportation Authority propounded this discovery on plaintiffs Scott Grindy and Anne Grindy on December 19, 2024. (Cummins Dec. paras. 4 & 5 & Exs. A and B.) Neither plaintiff has responded. (Id. paras. 7-15.) By failing to timely respond, plaintiffs have waived their objections to the discovery requests. (CCP 2030.290(a), 2031.300(a).)
Plaintiffs are ordered to serve verified responses, without objections, accompanied by responsive documents, within two weeks of notice of entry of this order. If the responsive documents are voluminous plaintiffs may make a rolling production but shall complete production within 30 days.
The Harbor District seeks sanctions against Plaintiffs and their counsel. The court concludes that the failure to submit to an authorized method of discovery is a misuse of the discovery process and orders that Plaintiffs and their counsel Gregory C. Cattermole jointly and severally shall pay $1575 to the Transportation Authority within 30 days of notice of entry of this order.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 301 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. Any party who contests a tentative ruling must send an email to contestdept301tr@sftc.org with a copy to all other parties by 4pm stating, without argument, the portion(s) of the tentative ruling that the party contests. The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept301tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
