Plaintiff has not met its initial burden of establishing that it was in peaceable and undisturbed possession of the premises for any period of time immediately prior to Defendant's alleged forcible entry. As each of every one of the issues upon which Plaintiff seeks summary adjudication is premised on this fact being established, summary adjudication of each of the specified issues is denied. Even if Plaintiff had shifted the burden, triable issues exist as to whether the Defendant continuously resided at the premises. =(501/CFH)
