PLAINTIFF Motion For Judgment Pursuant To Stipulation; is DENIED. No evidence that Plaintiff gave the pre-requisite two warnings, not only emailed to Defendant's counsel but also posted to the subject premises as required by Paragraph 13 of the Stipulation, and including all information required by Paragraph 13.
The Court also notes that the various changes to Defendant's rent described by Plaintiff are inconsistent with the Notices of Rent Adjustment attached to Declaration of Bridgette Moore, and there is no evidence that the notices which purported to increase Defendant's rent were served to Defendant at least 30 days before the increased amount went into effect; and additionally, that Plaintiff does not allege Defendant failed to comply with Paragraphs 9 and 12 of the Stipulation for at least 6 months after signing the Stipulation.
This matter will be heard in department 505 by the Honorable Michelle Tong at 1:30 p.m. per the order of the presiding judge. (505/MT)
