Plaintiffs Elba Vazquez and Francisco Gonzalez's Motion to Compel Deposition of David Garibaldi is DENIED. There is no demonstration by either party of meet and confer efforts for the issues presented in this motion prior to filing this motion. (See Code of Civil Procedure section 2016.040.)
In looking at the declarations of Oliver Vallejo and Adam Eberts and their attached exhibits, the parties had a deposition noticed for October 10, 2025. Defendant produced David Garibaldi for deposition on October 10, 2025. (Vallejo Reply Decl. 2.) In totality, there was no need for this motion to be filed at all as Plaintiffs failed to make any efforts to resolve this dispute on their own before filing a motion to compel.
Defendant's request for sanctions in the amount of $750 is granted, payment no later than November 24, 2025, receipt filed with the court by December 3, 2025. Parties are advised to meet and confer in good faith prior to filing future discovery motions.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 302 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept302tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
