Defendant and Cross-Defendant CNC Investments, Inc.'s unopposed motion to deem admitted Requests For Admissions ("RFAs") served on Plaintiff Katherine Papageorge is GRANTED IN PART AND DENIED IN PART. The record demonstrates Plaintiff did not provide any responses to the RFAs. No meet and confer requirement exists for motions to compel responses for requests for production of documents when no responses have been provided. (See Code of Civil Procedure section 2033.280.) Defendant and Cross-Defendant's RFAs, executed July 15, 2025, are deemed admitted.
Plaintiff Katherine Papageorge has not demonstrated she acted with substantial justification in connection with this discovery. Plaintiff Katherine Papageorge shall pay $260.00 to Defendant and Cross-Defendant CNC Investments, Inc. as sanctions, payment no later than November 18, 2025. (See Code of Civil Procedure sections 2023.030, 2033.280(c).) To the extent Plaintiff seeks additional or different relief, the motion is denied.
Defendant and Cross-Defendant is ordered to prepare separate proposed orders, one for each of its motions, which repeats the relevant above text verbatim and email them to contestdept302tr@sftc.org prior to the time set for hearing.
