Community Creative Network, Case no. 26VECV01589 Hearing date August 31, 2026 Plaintiff Ward's Motion to Deem RFAs Admitted - UNOPPOSED Plaintiff Ward, trustee of the Ward Family Trust and the Raeleene K. Darling Trust, sues defendant Community Creative Network for unlawful detainer. Plaintiff moves to deem RFAs admitted. The motion is unopposed. If a party to whom requests for admission are directed fails to serve a timely response, propounding party may move to deem the matters admitted. Code Civ. Proc. Sec.2033.280(2)(b). Plaintiff served RFAs, set one, on defendant 6/18/26. Decl. Szkolnik, para. 5, exh.
1. Despite multiple extensions, defendant failed to serve responses. Id. at paras. 7-9. At the case management conference on 7/16/26, defense counsel represented that verified discovery responses would be provided within 48 hours. See 7/16/26 Min. Order. No responses were provided. Decl. Szkolnik, para.
7. The motion is unopposed. An order deeming RFAs admitted is warranted. Sanctions are mandated. Code Civ. Proc. Sec.2033. Plaintiff requests $1,730 in sanctions. Decl. Szkolnik para.
12. Counsel requests an hourly rate of $550/hour, based upon his 40 years of experience and emphasis on unlawful detainer matters. Id. This is reasonable in light of counsel's expertise and is granted. Plaintiff requests 3 hours for motion drafting and appearance at hearing, $550 x 3 = $1,650. Id. This is reasonable.
