Defendant did not comply with the court's order for the phone inspection to occur by July 6, 2026, nor did defendant seek relief from the express terms of the order. The court's timing was deliberate, and was intended to enable Plaintiff to either obtain the metadata or to have sufficient time before trial to make a spoliation motion.
Plaintiff represents in reply briefing that the phone inspection, which occurred more than a month after the court's deadline, revealed that metadata from the photos had been deleted. The parties should be prepared to discuss a surreply briefing schedule for defendant to respond to this evidence. The parties should further be prepared to discuss a briefing schedule concerning whether sanctions short of terminating sanctions (such as an evidentiary sanction that prohibits defendant from introducing any photographs at trial for which metadata was not provided) will cure any prejudice from deleted metadata or from the plaintiff's inability to obtain an order regarding spoliation before trial.
