PLAINTIFF DELAWARE LAKEWOOD APARTMENTS, LLC Motion For Entry Of Judgment Pursuant To Stipulation; is DENIED without prejudice. Plaintiff requests monetary damages which include both rent and utilities. The terms of the parties' Stipulation do not contemplate any ongoing payment of utilities or other non-rent fees. Because the moving papers do not separate the amount requested for rent from that requested for utilities, the amount of monetary damages Plaintiff requests exceeds that authorized by the Stipulation, and the Court cannot determine the appropriate amount.
This matter will be heard by the Honorable Anthony A. Trendacosta per the order of the presiding judge. =(501/AAT)
