CROSS DEFENDANT Motion To Dismiss First Amended Cross-Complaint; based on (1) discretionary dismissal pursuant to CCP 583.410 and (2) failure to file a Second Amended Cross-Complaint following granting of a motion for judgment on the pleadings is GRANTED. The cross-action is dismissed with prejudice. No opposition filed. [Note: Moving papers fail to mention that there was a stipulation and Order thereon (3/21/2024 Haines, J.) which stayed the Cross-Complaint during the pendency of the bankruptcy.] The Court will prepare its own order. =(501/MEW)
