Candelas, filed this petition for an order authorizing the release of the digital assets of Petitioner's deceased daughter, Kimberly Candelas, from Respondent, Google LLC. The motion was heard on May 6, 2026.

After oral argument, the court continued the motion to August 27, 2026 because Petitioner did not provide proof of service on Respondent. [1] On June 18, 2026, Petitioner re-filed the petition and proof of service of the petition on Respondent by certified mail. Petitioner has addressed the defect noted in the court's previous order. [1] The court previously noted that the Petition did not indicate whether judicial proceedings " have been initiated under this code to administer the estate of the deceased user" as stated under Probate Code section 871(e)(1) which prevented the court could from determining whether the Probate Division or the Civil Division was the proper court to hear the petition. At the hearing, Petitioner represented to the court that no other proceedings have been initiated. Petitioner also stated the same in her declaration filed on June 18, 2026.
