Tentative Ruling: Plaintiff Roddie McElhaney’s (“Plaintiff”) unopposed motion for leave to amend the complaint is GRANTED.

Plaintiff filed his complaint in this action on October 3, 2023, when he still had title to his home. Plaintiff contends that Defendants have since taken title to his home in a wrongful alleged foreclosure sale, requiring him to amend his complaint accordingly. (Decl. McElhaney, ¶1.)

Plaintiff moved for leave to amend his complaint, which motion was denied without prejudice on March 13, 2025 for failure to comply with CRC Rule 3.1324.

Plaintiff seeks leave to file an amended complaint to add additional causes of action based on the foreclosure sale that allegedly was wrongful and occurred after the filing of the original complaint. Plaintiff has submitted the required declaration and has now complied with CRC Rule 3.1324. Leave to amend is proper.

No opposition to the motion was filed. A party’s failure to oppose a motion is construed as a concession on the merits of the motion. (See D.I. Chadbourne, Inc. v. Superior Court (1964) 60 Cal.2d 723, 728, n.4.)

The motion is UNOPPOSED and GRANTED.

SUPERIOR COURT OF CALIFORNIA COUNTY OF SACRAMENTO

The minute order is effective immediately. No formal order pursuant to CRC Rule 3.1312 or further notice is required.
