Plaintiff Synchrony Bank’s request for judicial notice is DENIED. The request fails to comply with California Rules of Court, Rule 3.1306(c).

The copy of the Settlement Agreement provided with counsel Spencer Penuela’s declaration shows that Defendant Heather Wade agreed to repay Plaintiff $3,414.24 in total, by paying the minimum sum of $72.50 on or before March 28, 2025, and thereafter, by paying $72.50 or more on or before every other Friday through and including January 1, 2027, with a final payment due on January 15, 2027, of $6.74.

Moreover, the declaration of Spencer Penuela sufficiently shows that Defendant defaulted under the Settlement Agreement and Plaintiff is entitled to the entry of judgment in the sum of $2,700.29.
