Defendant's Motion to Vacate Judgment is DENIED. Defendant has failed to demonstrate that the judgment was entered due to Defendant's mistake, inadvertence, surprise, or excusable neglect. Defendant left the country for several months while this action was pending and at issue. The Notice of Time and Place of Trial was mailed to Defendant's address of record, as it appears on Defendant's Answer, nine days before Defendant departed the country.
Defendant's August 21, 2026 filing is stricken, as the Order Shortening Time for this motion expressly states that there shall be no written reply. =(501/CFH)
