Defendant has already filed multiple motions seeking to set aside or vacate the default and/or default judgment on the asserted grounds that they are void. Defendant's previous motions were denied on January 20, 2026, February 25, 2026, and June 4, 2026. The most recent ruling on June 4, 2026 expressly states that the judgment is not void, and why.
This motion seeking the same relief previously denied is therefore subject to CCP 1008 and must be based on new or different facts, circumstances, or law. Defendant offers no such new or different facts, circumstances, or law supporting a different outcome on this repetitive motion. Moreover, the specific legal argument upon which the instant motion is based was raised in at least one of Defendant's previous motions and considered by the Court before that motion was denied on February 25, 2026.
Plaintiff's opposition, filed June 26, 2026, was not considered. This matter was previously continued from July 2, 2026 for Plaintiff to comply with LRSF 2.7B and provide a courtesy copy of the opposition. The Court did not receive any courtesy copy of the opposition.=(501/CFH)
