CITY AND COUNTY OF SAN FRANCISCO VS. SHIMMICK CONSTRUCTION COMPANY, INC. ET AL

Matter on the DISCOVERY / LAW AND MOTION calendar for Tuesday, Dec-23-2025, LINE 2. FURTHER HEARING RE: MOTION FOR SUMMARY JUDGMENT.

Cross-defendant Precision Engineering, Inc. 's motion for summary judgment is granted. Precision satisfied its summary judgment burden by showing that the discovery responses of cross-complainant Shimmick Construction Company, Inc. are devoid of facts showing that any conduct of Precision is responsible for the construction defects complained of by plaintiff City and County of San Francisco and Shimmick. Because Shimmick has not submitted any evidence on this motion showing that Precision is responsible for those construction defects, Precision is entitled to summary judgment in its favor.

This ruling does not apply to any claim that Shimmick may have that Precision breached a contractual duty to defend Shimmick for any aspect of this case up to October 10, 2025. That claim was not alleged in Shimmick's cross-complaint against Precision or addressed in the motion papers filed by Precision.
