DEFENDANT LIZBETH HILL DEMURRER to COMPLAINT is OVERRULED. Service of the Three-Day Notice to Quit was compliant with C.C.P. 1162(a)(3) and sufficiently provided information to ascertain the expiration of the notice period. Therefore, the Complaint does not fail to state a cause of action on these grounds.
Further, the Complaint is not uncertain; the language referring to "Any Previous Notice Served" does not change the meaning or effect of the present Notice, Plaintiff's process server served the Notice in compliance with C.C.P. 1162(a)(3), and SF Administrative Code 37.9D refers to tenants, while Defendant is a former owner holding over on the property, and is therefore not applicable. =(501/DWH)
