Tentative Ruling:

To continue plaintiff Maribel Hernandez’s motion to compel defendant Alvaro Nava’s response to Requests for Production of Documents, Set One to September 10, 2026 at 3:30 p.m. in Department 503. Plaintiff is to file a supplemental declaration authenticating and attaching copies of Plaintiff’s Request for Production of Documents, Set One and proof of service by September 3, 2026.

Explanation:

Plaintiff Maribel Hernandez (“Plaintiff”) moves to compel initial responses from defendant Alvaro Nava (“Defendant”) for Plaintiff’s Request for Production of Documents, Set One (“Set One”). Counsel for Plaintiff’s declaration indicates counsel intended to attach a copy of Set One and the proof of service on Defendant of Set One to counsel’s declaration. (Harris Decl., ¶ 2.) However, Set One and the proof of service were not attached. The court cannot grant the motion without authenticated copies of these documents. Accordingly, the motion to compel responses to Set One is continued to September 10, 2026 at 3:30 p.m. in Department 503, to allow time for Plaintiff to file a supplemental declaration that authenticates and attaches a copy of Set One and the proof of service of Set One. Plaintiff is to file the supplemental declaration with the attached documents by September 3, 2026.

Pursuant to California Rules of Court, rule 3.1312(a), and Code of Civil Procedure section 1019.5, subdivision (a), no further written order is necessary. The minute order adopting this tentative ruling will serve as the order of the court and service by the clerk will constitute notice of the order.
