(B) Petition to Remove Co-Guardians Yvette and Patrick McGrath

Letters of guardianship of the person were issued on August 10, 2016. This is a co-

guardianship, with the co-guardians being Patrick and Yvette McGrath (the maternal

grandparents) and Wayne and Brenda Wright (Ms. Wright being the paternal third

cousin).

Annual Review Hearing

To date, the annual guardianship status report (Judicial Council form GC-251) is not

in the court’s file.

Petition to Remove Co-Guardians Yvette and Patrick McGrath On July 15, 2026, pursuant to Probate Code sections 2650 and 2651, Brenda and

Wayne Wright (collectively, “petitioners”) filed a petition to remove Patrick and Yvette

McGrath as co-guardians, and confirm petitioners as the remaining co-guardians.

Petitioners allege that, since late 2022, the minor has resided exclusively and

continuously at petitioners’ home and during this time, petitioners have assumed one

hundred percent of the responsibility for the minor’s daily care, upbringing, supervision,

and support. Additionally, petitioners allege that Patrick and Yvette McGrath have

divorced. Petitioners claim that having four co-guardians, where only two of them are

actively providing daily care and exercising responsibility, creates unnecessary legal

complexity and the potential for confusion in medical, educational, and other decision-

making contexts.

On July 15, 2026, Patrick and Yvette McGrath submitted their written consent to

removal as co-guardians. They also waived notice of the hearing.

Proof of service filed July 28, 2026, shows that the petition was served upon all required parties via mail that same day. However, in a declaration filed August 6, 2026,

petitioners’ attorney indicates that the whereabouts of the minor’s biological mother

are unknown. It appears that petitioners mailed a copy of the petition to the mother’s

last known address. Additionally, counsel outlines the efforts petitioners made to locate

the mother and, on July 29, 2026, emailed a copy of the petition to the mother’s last

known email address.

The court, for good cause, may dispense with the notice otherwise required to be

given to a person as provided in Probate Code section 1460. (Id., subd. (e).) In the event

that the petition was not properly served upon the mother via mail or email, the court

finds good cause to dispense with the notice requirement for the instant petition as to

the mother only.

TENTATIVE RULING # 3:

(A) ANNUAL REVIEW HEARING: APPEARANCES ARE REQUIRED AT 8:30 A.M., FRIDAY,

AUGUST 21, 2026, IN DEPARTMENT FOUR.

(B) PETITION TO REMOVE CO-GUARDIANS YVETTE AND PATRICK MCGRATH: ABSENT

OBJECTION, PETITION GRANTED AS REQUESTED.
