Motion to Compel Arbitration
The unopposed motion by defendant Juan Villegas for an order compelling plaintiff Portfolio Recovery Associates, LLC to arbitrate Plaintiff’s claims in this action is GRANTED. (Code Civ. Proc., § 1281.2.) Petitioner/Defendant has met his burden of proving by a preponderance of the evidence the existence of a written agreement by the parties to arbitrate Plaintiff’s claims in this action. The parties are ordered to binding arbitration. In accordance with the terms of the arbitration agreement, plaintiff has selected the American Arbitration Association as the arbitration provider.
The present action is stayed in accordance with Code of Civil Procedure section 1281.4 pending the outcome of arbitration. The Court sets a review hearing re: status of arbitration on Thursday, February 25, 2027, at 10:00 a.m. in Courtroom 9. The Court has prepared and will sign an order based on the proposed order submitted with the moving papers.
