Tentative Ruling
NOTICE:
Please take notice, Department 54 has moved to Department 16C at the Tani G. Cantil- Sakauye Courthouse. The new courthouse is located at 500 G Street, Sacramento, CA 95814.
TENTATIVE RULING:
Plaintiff Heather Ramirez-Koteys (Plaintiff) motion to compel defendant American Honda Motor Co., Inc. (Defendant) to serve verified further responses to Plaintiffs Special Interrogatories, Set Two, numbers 62-104 is DROPPED due to defective service,
Plaintiff filed and served her motion on April 13, 2026, with an original hearing date set for November 3, 2026. On April 21, 2026, the Court granted Plaintiffs ex parte application for an order shortening time and advanced the hearing date to todays date. Plaintiff, however, failed to serve an amended notice of the new hearing date on Defendant. Defendant filed an objection to this motion based on defective service on June 15, 2026.
Defective service deprives the court of jurisdiction (Lee v. Placer Title Co. (1994) 28 Cal.App.4th 503, 509),
Accordingly, the motion is DROPPED.
The minute order is effective immediately. No formal order pursuant to California Rules of Court, Rule 3.1312, or further notice is required.
