DISCUSSION Plaintiff Creditors Adjustment Bureau, Inc ("Plaintiff") moves the court for an order striking defendant Greenfield Landscaping and Maintenance, Inc.'s ("Defendant") answer to the complaint. The court grants the motion to strike because Defendant is a corporation that is no longer represented by counsel. "[U]nder ¿ a long-standing common law rule of procedure, a ¿ corporation [or other business entity], ¿ unlike a natural person, cannot ¿ represent ¿ itself before courts of record in propria persona, nor can it represent itself through a corporate officer, director or other employee who is not an attorney. ¿ It must be represented by licensed counsel in proceedings before courts of record. " ¿ (CLD Construction, Inc. v. City of San Ramon ¿ (2004) 120 Cal.App.4th 1141, 1145.)
The court granted the motion filed by Defendant's former attorneys Ronald Norman and Yunchao Song to be relieved as counsel for Defendant on April 20, 2026, conditioned on the moving counsel giving notice of the court's ruling to all parties and filing a proof of service of the notice of ruling and the signed order granting the motion on Defendant. (April 20, 2026 Order granting Motion to be Relieved). Defendant's former counsel gave notice and filed the proofs of service as required on April 23, 2026, and were thus relieved as counsel.
Because Defendant has not retained substitute counsel, the court exercises its discretion to strike Defendant's answer. (CLD Construction, Inc., ¿ supra, 120 Cal.App.4th at p. 1145; Code Civ. Proc., Sec. 436, subd. (b) [court may, at any time in its discretion and upon terms it deems proper, strike any pleading "not drawn or filed in conformity with the laws of this state"].) ¿¿¿
ORDER The court GRANTS plaintiff Creditors Adjustment Bureau, Inc.'s motion to strike the answer of defendant Greenfield Landscaping and Maintenance, Inc. The court orders that defendant Greenfield Landscaping and Maintenance, Inc.'s answer is stricken.
The court orders plaintiff Creditors Adjustment Bureau, Inc. to file a Request for Entry of Default (CIV-100) as to defendant Greenfield Landscaping and Maintenance, Inc. no later than August 26, 2026. The court sets an Order to Show Cause re: entry of default and default judgment for hearing on October 20, 2026, at 8:30 a.m., in Department 513. The court orders plaintiff Creditors Adjustment Bureau, Inc. to file default judgment documents required by California Rules of Court, rule 3.1800 (including a proposed judgment on JUD-100) no later than September 24, 2026.
The court orders that (1) the trial set in this action on November 4, 2026, and (2) the Final Status Conference set on October 22, 2026, are vacated.
