Plaintiff Yuen Peng Cheong's Motion For Protective Order Shielding Her From Defendants' Misuse Of Request For Production Of Documents And Sanctions Against Defendants And Counsel, Jointly And Severally, In The Amount Of $5,060.00 is DENIED.
Plaintiff moves under Code of Civil Procedure section 2031.060. Under section 2031.060, the moving party must demonstrate that they met and conferred consistent with section 2016.040. (See Code of Civil Procedure sections 2031.060(a).) "A meet and confer declaration in support of a motion shall state facts showing a reasonable and good faith attempt, either in person, by telephone, or by videoconference, to informally resolve each issue presented by the motion." (Code of Civil Procedure section 2016.040.)
Plaintiff failed to demonstrate adequate meet and confer. Plaintiff presents evidence counsel sent a letter. But the record contains no evidence counsel even tried to confer in real time, i.e., "either in person, by telephone, or by videoconference."
In any event, Plaintiff cannot reasonably be surprised that her 14-count, 45-page FAC with 134 paragraphs of allegations is going to trigger substantial discovery. Nor can Plaintiff reasonably be surprised that Defendants might want to obtain all documents underlying or supporting each of the allegations in the complaint. Plaintiff's request that the court excuse her from every request in Defendants' RFPs is unreasonable and unsupported. The request, thus, is denied. The court is disheartened by Plaintiff's decision to tax public judicial resources for motions such as this. Sanctions are denied.
