Defendants' Motion to Contest Claim of Privilege is GRANTED as unopposed.
In response to Defendant's Request for Production of Documents, Set One, Plaintiff produced a document she identified as "Timeline Document: Detailed timeline of events from March 30, 2022, through June 22, 2022." At Plaintiff's deposition, Defense counsel asked Plaintiff about the document. Thereafter, on July 15, 2026, Plaintiff sent a letter to Defendants demanding, among other things, that Defendants sequester, return or destroy the timeline document on the grounds that it is a privileged attorney-client communication.
Defendants filed this motion seeking an order that the timeline document is not privileged, and that Defendants have no obligation to sequester, return, or destroy the document. The Court advanced the hearing on the motion and ordered Plaintiff to file any opposition by August 17, 2026. Plaintiff filed no opposition to the motion.
There is no evidence that the timeline document is privileged. Any contention that Plaintiff did not intend to reveal the document to Defendants is belied by the fact that the timeline document was specifically identified in the text of Plaintiff's October 2025 written Response to the Request for Production of Documents, Set One, signed by both Plaintiff and Plaintiff's counsel.
The Court HEREBY ORDERS: Defendant has no obligation to sequester, return or destroy the timeline document.
