DEFENDANT MARTIN ENG Notice Of Motion And Moiton To Vacate Order Denying Defendant'S Motion For Summary Judgment is DENIED.

The Court denied Defendant's Motion for Summary Judgment on the basis that Defendant had not met his initial burden of showing that Plaintiff could not establish the elements of his cause of action, i.e., that Defendant had not shown that Plaintiff did not possess and could not reasonably obtain the evidence necessary to establish the essential elements of his cause of action. The Court did not apply an incorrect legal standard. =(501/CFH)
