Petition to Confirm Successor Trustees and Trust Assets

On June 15, 2026, pursuant to Probate Code section 850, petitioner Bruce Chen

(“petitioner”) filed the instant petition requesting the court to: (1) confirm the existence

of the Mary R. Shirley Revocable Living Trust dated January 3, 2005 (the “Trust”),

including Schedule A; (2) confirm petitioner as the successor trustee; and (3) confirm

that the real property, commonly known as 1657 Venice Drive, South Lake Tahoe,

California, is Trust property. Proof of service filed July 20, 2026, shows that the petition was served upon the

Trust beneficiaries via mail on July 15, 2026. However, 30 days’ notice is required. (Prob.

Code, § 851, subd. (a).) The court may not shorten the time for giving notice under

Probate Code section 851. (Prob. Code, § 851, subd. (d).)

The court, on its own motion and in the interest of judicial economy, continues the

hearing to September 25, 2026, and directs the petitioner to serve timely notice of the

petition upon all parties entitled to notice.

TENTATIVE RULING # 3: THE COURT, ON ITS OWN MOTION AND IN THE INTEREST OF

JUDICIAL ECONOMY, CONTINUES THE HEARING TO 8:30 A.M., FRIDAY,

SEPTEMBER 25, 2026, IN DEPARTMENT FOUR AND DIRECTS THE PETITIONER TO SERVE

TIMELY NOTICE OF THE PETITION UPON ALL PARTIES ENTITLED TO NOTICE.
